Laura Prepon and Ben Foster had a quick divorce, finalizing the split in less than six months, but the end of their marriage quickly turned messy.

Us Weekly confirmed that Foster filed for divorce from Prepon in November 2024 after six years of marriage. He cited “irreconcilable differences” as the reason for the split and listed their date of separation as September 9, 2024. (The pair share daughter Ella, born in 2017, and a son, whose name has not been publicly revealed, born in 2020.)

In the months that followed, Foster and Prepon went back and forth via court documents. Prepon claimed Foster had a drinking problem, which he denied, while Foster accused the actress of “inappropriate marital conduct,” which she also refuted.

November 2024

In his initial filing, Foster asked the court to make an “equitable division” of their assets and debt in accordance with their 2018 prenuptial agreement, per docs obtained by Us. He also anticipated he and Prepon would enter their “marital dissolution agreement and agreed parenting plan” into the final decree of divorce.

December 2024

The following month, Prepon filed a response to Foster’s plea to the court for a temporary custody schedule after not agreeing to an arrangement. According to docs obtained by Us, Prepon requested that Foster not drink alcohol 12 hours before he spends time with their two children and abstain during the visitation. She also suggested that Foster could consider having a supervisor for his parenting time.

Prepon’s lawyers shared that the actress had concerns about her and Foster’s children staying at their dad’s new home because of his alleged “longstanding history of alcohol abuse.” Prepon recalled Foster allegedly becoming “so inebriated” after their daughter was born in 2017 that he locked himself out of their New York apartment where she allegedly found him asleep on the doorstep in his underwear.

In the filing, Prepon claimed that Foster did not return home to see his kids after wrapping production on a movie in August 2024 after not seeing his children “in almost four weeks.”

“Instead, despite his statements to [Laura] that he would not be going to the Venice Film Festival, [Ben] nonetheless was spotted in Italy on the red carpet posing without his wedding ring,” the paperwork continued. “Despite [Ben’s] repeated absence and unpredictability, [Laura] has continued to provide the children with the necessary stable environment and has continued to ensure that the children maintain a regular routine.”

Foster’s attorney addressed the Prepon’s legal response in a statement to In Touch, which read, “Laura Prepon’s filing is the definition of falsehood and a disturbing fiction.”

March 2025

Months after Prepon alleged Foster had a drinking problem, he filed an amended petition. According to docs obtained by In Touch, he accused Prepon of “inappropriate marital conduct.”

“[Ben] would respectfully show that [Laura] has been guilty of such cruel and inhuman treatment or conduct (i.e.; inappropriate marital conduct) towards [Ben] … which renders further cohabitation unsafe and improper,” the docs stated.

Foster asked the court to enforce the prenuptial agreement he and Prepon signed on May 21, 2018, in addition to determining a custody schedule and the amount of child support for him to pay Prepon. Foster is also asking to sell his and Prepon’s marital home which they purchased jointly in 2024.

Prepon denied she was guilty of “inappropriate marital conduct,” in docs obtained by In Touch that same month. “[Laura] asserts the affirmative defense to any allegations brought against her that the ill conduct of [Ben] was a justifiable cause for any conduct complained of against her and [Laura] therefore requests that this court dismiss [Ben’s] cause of action for divorce,” her attorney argued at the time.

Later that month, In Touch reported that the exes agreed to selling their shared Nashville estate, according to a March 24 filing. Prepon and Foster informed the court they will be listing the home for $4.5 million and will both continue paying mortgage, taxes and insurance payments pending the closing of the sale. After mortgage payments and closing costs are paid, net proceeds from the sale will pay Prepon up to $977,987. Any remaining proceeds will be equally split between Prepon and Foster.

“If the proceeds do not equal $977,987, [Prepon] shall receive 100 percent of the proceeds and neither party shall have any further claims against the other,” the filing read, per In Touch.

April 2025

Prepon and Foster reached a divorce settlement in April 2025, agreeing to uphold their prenuptial agreement. The exes agreed that they will each keep their respective vehicles, which were listed in their names, per docs obtained by Us.

Their individual checking, savings, investments, stocks or crypto currency will also remain their property, according to the marital dissolution assessment, which was signed on April 14. Foster will retain 100 percent ownership of his business Perfect Bananafish, Inc., while Prepon will keep 100 percent ownership of her company Laura P. Enterprises, Inc., per the docs.

Prepon and Foster also agreed to “dissolve” their joint company Infinity Rose, LLC, once they finalize the sale of their joint home in Nashville. While the exes agreed not to pay spousal support or alimony, they did come to a child support agreement.

Foster — who revealed his gross monthly income as $70,509.92 — will pay Prepon $5,500 a month in child support, according to the docs. (Prepon’s gross monthly income was listed as $22,205.50.)

Prepon will be the primary household for their two children, who will live with her for 227 days of the year. The kids will live with Foster the remaining 138 days, and the coparents will split custody during the week. The actors agreed to split the costs of tuition and future school-related expenses.
